By accessing this website or engaging Digibyte Kraft IT Solutions ("we", "us", "Company") for any service, you ("Client") agree to these Terms & Conditions. If you do not agree, please do not use our website or services.
We provide digital marketing, web design, web development and related IT services. The exact scope, deliverables, timelines and fees for each engagement are defined in a separate proposal, statement of work or invoice, which together with these terms forms the agreement between us.
Unless stated otherwise in a proposal, project work begins after receipt of the agreed advance. Retainer fees are billed monthly in advance. All invoices are payable within 7 days of issue. Late payments may attract a service-pause and a reasonable late fee.
The Client agrees to provide timely access to required accounts, content, brand assets and approvals. Delays in providing inputs may impact project timelines without liability on our part.
Upon full payment, final deliverables produced specifically for the Client are transferred to the Client. We retain ownership of our pre-existing tools, frameworks, internal templates and know-how. We may showcase non-confidential work in our portfolio and case studies unless the Client requests otherwise in writing.
Both parties agree to keep non-public information shared during the engagement confidential and to use it only for the purpose of delivering the services.
Services are provided on an "as is" basis. We do not guarantee specific business outcomes such as rankings, traffic or revenue, as these depend on factors outside our control. To the maximum extent permitted by law, our total liability for any claim arising out of the services is limited to the fees paid by the Client for the specific service giving rise to the claim in the preceding 3 months.
Refunds and cancellations are governed by our Return Policy, which forms part of these terms.
Either party may terminate an engagement with 15 days' written notice. Fees for work already performed up to the termination date remain payable.
These terms are governed by the laws of India and any disputes shall be subject to the exclusive jurisdiction of the courts at Delhi.
